Boise man accused of pepper spray attack

BOISE -- A 32-year-old Boise man who had been arguing with his roommates sprayed a can of pepper spray inside a home on West Kootenai Street early Tuesday morning, according to police.

According to the Boise Police Department, 32-year-old Derek Thomas Dayley is currently in the Ada County Jail. Dayley is charged with six counts of misdemeanor battery after officers say he sprayed the stinging substance inside the home, affecting six people inside.

It's not clear if all six were roommates, or possibly visitors in the home.

Police say Dayley had apparently been drinking alcohol throughout the day, woke up sometime late Monday night or early Tuesday morning, and had a verbal argument with several other people.

They say shortly afterward, Dayley left the home and returned with the pepper spray.

The 32-year-old Boise man is also charged with misdemeanor malicious injury to property for breaking a large mirror.

Police arrested Dayley around 3:40 a.m. Tuesday.
